1. AGREEMENT TO TERMS

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MECE Guru ("Company," "we," "us," or "our") regarding your use of the MECE Guru mobile application (the "App") and related services (collectively, the "Services").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not download, install, access, or use the App.

2. DESCRIPTION OF SERVICE

MECE Guru is a mobile application available on iOS and Android platforms that provides:

  • Business case interview practice and preparation tools
  • Mental math drills and exercises
  • AI-powered voice coaching sessions
  • Practice scenarios and case studies
  • Performance tracking and analytics
  • Leaderboards and achievement systems

The App is available at mece.guru and operates on a freemium model with optional premium features.

3. ELIGIBILITY AND ACCOUNT REGISTRATION

3.1 Age Requirements

You must be at least 13 years of age to use the Services. If you are under 18 years of age, you must have your parent or legal guardian's permission to use the Services.

3.2 Account Creation

  • The App provides anonymous authentication by default
  • Optional sign-in via Apple ID or Google account (when available)
  • You are responsible for maintaining the confidentiality of your account credentials
  • You agree to provide accurate and complete information when creating an account
  • You are responsible for all activities that occur under your account

3.3 Account Security

You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

4. PREMIUM ACCESS AND PAYMENT TERMS

4.1 Premium Features

Premium access is available through a one-time purchase for lifetime access to enhanced features including:

  • Unlimited AI coaching sessions
  • Advanced practice scenarios
  • Detailed performance analytics
  • Priority access to new features
  • Ad-free experience

4.2 Payment Processing

  • Payments are processed through Adapty integration
  • Product ID: com.meceguru.premium.annual
  • All purchases are final unless otherwise required by applicable law
  • Prices are subject to change with notice

4.3 Refund Policy

  • Refunds are provided in accordance with Apple App Store and Google Play Store policies
  • Refund requests must be submitted through the respective app store
  • We reserve the right to deny refund requests for users who violate these Terms

5. USER CONTENT AND CONDUCT

5.1 User-Generated Content

By using the Services, you may generate content including but not limited to:

  • Voice recordings and transcripts
  • Practice session answers and responses
  • Performance data and statistics
  • Profile information

5.2 Content License

You retain ownership of your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, and display such content solely for the purpose of operating and improving the Services.

5.3 Content Restrictions

You agree not to submit content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights
  • Contains malicious code or harmful components
  • Is false, misleading, or deceptive
  • Is harassing, threatening, or abusive

5.4 Voice Data

  • Voice recordings are processed using ElevenLabs technology
  • Transcripts are stored in cloud storage (maximum 10MB per file)
  • Voice data may be used to improve AI coaching features
  • You can request deletion of your voice data at any time

6. ACCEPTABLE USE POLICY

You agree not to:

  • Use the Services for any illegal purpose or in violation of any laws
  • Attempt to gain unauthorized access to any portion of the Services
  • Interfere with or disrupt the Services or servers
  • Use automated means to access the Services without our permission
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use the Services to harass, abuse, or harm other users
  • Manipulate or artificially inflate leaderboard rankings
  • Share premium account access with unauthorized users
  • Use AI coaching features to generate inappropriate or harmful content

7. INTELLECTUAL PROPERTY RIGHTS

7.1 Our Content

All content provided through the Services, including but not limited to:

  • Practice cases and scenarios
  • Mental math problems
  • Coaching algorithms and methodologies
  • User interface designs
  • Text, graphics, logos, and images

Is owned by MECE Guru or its licensors and is protected by copyright, trademark, and other intellectual property laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use in accordance with these Terms.

7.3 Feedback

Any feedback, suggestions, or ideas you provide regarding the Services may be used by us without any obligation to compensate you.

8. PRIVACY AND DATA PROTECTION

8.1 Data Collection

We collect and process data as described in our Privacy Policy, including:

  • User profiles stored in Supabase cloud database
  • Session data and performance statistics
  • Device IDs (UUID format) for tracking
  • Local data cached via AsyncStorage
  • No IDFA or IP address collection

8.2 Third-Party Services

The Services integrate with the following third-party providers:

  • Supabase: Database and authentication services
  • Adapty: Payment processing and subscription management
  • ElevenLabs: Voice AI and speech synthesis
  • OpenAI: GPT-4 powered coaching features
  • Sentry: Optional error tracking (when enabled)

Each third-party service operates under its own terms and privacy policies.

9. DISCLAIMERS AND LIMITATIONS OF LIABILITY

9.1 No Guarantee of Outcomes

THE SERVICES ARE PROVIDED FOR EDUCATIONAL AND PRACTICE PURPOSES ONLY. WE DO NOT GUARANTEE:

  • Success in job interviews or career advancement
  • Accuracy of AI coaching advice
  • Improvement in case interview performance
  • Admission to any educational or professional program

9.2 Service Availability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MECE GURU BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

9.4 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless MECE Guru, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Your use of the Services

11. ACCOUNT TERMINATION

11.1 Termination by You

You may terminate your account at any time by:

  • Deleting the App from your device
  • Requesting account deletion through the App settings
  • Contacting our support team

11.2 Termination by Us

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activities
  • You abuse the Services or other users
  • Required by law or legal process

11.3 Effect of Termination

Upon termination:

  • Your access to premium features will cease
  • Your User Content may be deleted
  • You will not be entitled to any refunds for unused services

12. GOVERNING LAW AND DISPUTE RESOLUTION

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.

12.2 Dispute Resolution

Any dispute arising out of or relating to these Terms or the Services shall be resolved through the following process:

  1. Informal Resolution: First attempt to resolve the dispute informally by contacting us
  2. Mediation: If informal resolution fails, participate in mediation
  3. Arbitration: Final resolution through binding arbitration under the American Arbitration Association rules

12.3 Class Action Waiver

YOU AGREE THAT ANY DISPUTES SHALL BE RESOLVED INDIVIDUALLY AND NOT AS PART OF A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

13. MODIFICATIONS TO TERMS

13.1 Right to Modify

We reserve the right to modify these Terms at any time. We will notify you of any material changes by:

  • Posting a notice in the App
  • Sending an email to registered users
  • Updating the "Last Updated" date

13.2 Continued Use

Your continued use of the Services after any modifications constitutes acceptance of the updated Terms.

14. GENERAL PROVISIONS

14.1 Entire Agreement

These Terms constitute the entire agreement between you and MECE Guru regarding the Services and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be considered a waiver of such right or provision.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, or acts of civil or military authorities.

15. EXPORT COMPLIANCE

You agree to comply with all applicable export and import laws and regulations in your use of the Services. You may not use the Services if you are located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country.

17. ADDITIONAL TERMS FOR SPECIFIC FEATURES

17.1 Leaderboards

  • Rankings are based on performance metrics
  • We reserve the right to remove users who manipulate rankings
  • Leaderboard participation is optional

17.2 Achievements and Gamification

  • Badges and points have no monetary value
  • Achievement progress may be reset if violations are detected
  • We may modify achievement criteria at any time

17.3 AI Coaching Features

  • AI responses are generated algorithmically and may contain errors
  • Do not rely solely on AI coaching for career decisions
  • AI features are subject to usage limits for free users

18. ACKNOWLEDGMENT

BY USING THE MECE GURU APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
